Medical Emergency / Crisis

The Platform is not for emergencies or crisis care. If you are in immediate danger or considering self‑harm, call 911 (or your local emergency number), go to your nearest emergency department, or contact a crisis line immediately. Do not use the Platform for emergency care.

These Terms of Use (the "Terms") govern your access to and use of: (1) the website(s) located at www.wecarefast.com and www.wecarefast.ca and any related sub‑domains (the "Website"), and (2) any software, products, portals, mobile applications, features, content, customer support and other services provided by We Care Fast Solutions Ltd. ("WeCareFast," "we," "us," or "our") (collectively, the "Platform"). These Terms form a binding agreement between WeCareFast and each person or entity that accesses or uses the Platform ("you").

By accessing or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and ourPrivacy Policy, which is incorporated by reference. If you do not agree, do not access or use the Platform.

1. Definitions & Roles

Providers: Independent, self‑employed, regulated health professionals (e.g., psychiatrists, psychologists, social workers, counsellors, nurse practitioners) who may offer clinical services to you using their own professional judgment ("Provider Services"). Providers are not our employees, agents, partners, or representatives.
Support Staff: WeCareFast staff who provide administrative and coordination assistance only ("Support Services") and do not provide regulated health services.
Services: Collectively, the Provider Services and Support Services that you may access through the Platform.
Content: All information, text, interfaces, graphics, videos, software, trademarks, logos and other materials made available on or through the Platform.

2. Our Platform – What We Do and Don't Do

WeCareFast is a technology platform that helps you find, schedule and pay for Provider Services and communicate with Providers. We do not practice medicine or any other regulated health profession and we do not supervise or control Providers' clinical judgment. We do not guarantee that Provider Services are appropriate, effective, available, or will achieve any outcome. Your clinical relationship is exclusively with your Provider.

No Medical Advice. Any general health Content on the Platform is for informational purposes only and is not medical advice and must not be relied upon for diagnosis or treatment. Always seek the advice of a qualified health professional for questions about a medical condition. Never delay seeking professional advice because of something you have read on the Platform.
Geography. Unless we state otherwise in writing, the Platform and Services are offered only in Canada and only where the Provider is authorized to practise and to deliver virtual care to you. Services may not be available in all provinces/territories.

3. Eligibility & Your Account

You must be the age of majority in your province/territory of residence and have legal capacity to agree to these Terms. To use certain features, you may need to create an account ("Account") with accurate and current information, keep your credentials confidential, and notify us immediately of any suspected unauthorized access. You are responsible for all activity under your Account.

Minors. A parent or legal guardian must create the Account and be present for all sessions unless the applicable provincial/territorial law permits otherwise and the Provider agrees. By permitting a minor to use the Platform, the parent/legal guardian agrees to these Terms on the minor's behalf.
We may suspend or terminate your Account without notice at any time for actual or suspected breach of these Terms or for risk, fraud, abuse, or unlawful activity.

4. Telehealth Consent & Risks

By using the Platform for care, you provide informed consent to receive virtual care from Providers via video, audio, chat, or other electronic means. You understand and accept the limitations and risks of telehealth, which may include: connectivity issues; delays; incomplete information; technology failures; privacy/security risks inherent to electronic communications; and the unavailability of in‑person examination. You may withdraw consent at any time by stopping use of telehealth and informing your Provider.

Recordings. Clinical sessions are not recorded by default. If a recording is proposed for quality assurance or training, it will only occur with your express, informed, written consent, and will be retained only for the period disclosed at the time of consent and then securely deleted. Recordings are not part of your clinical chart unless required by law or expressly stated.

5. Privacy & Personal Information

WeCareFast handles personal information in accordance with applicable privacy laws (including, where applicable, PIPEDA and provincial privacy statutes such as BC PIPA) and our Privacy Policy. Providers are independently responsible for their own clinical records and privacy obligations under their governing laws and colleges. We use reasonable physical, organizational, and technological safeguards, but no system is 100% secure. You accept the risk that security measures can fail.

Data Use. To operate the Platform, you grant us a limited, non‑exclusive licence to process your information (including personal information) only to provide and improve the Platform and Support Services, to comply with law, and as described in our Privacy Policy. We may create and use de‑identified and aggregated data for analytics, quality improvement, and reporting. We do not sell your identifiable personal information.

6. Booking, Cancellations, No‑Shows & Refunds

Session length and fees are disclosed at booking. By booking, you authorize us (or our payment processor) to charge your selected payment method for all amounts due, including taxes and authorized third‑party fees.

Cancellations/Rescheduling. You may cancel or reschedule at least 48 hours before the appointment start time at no charge. If you cancel/reschedule within 48 hours or do not attend, WeCareFast (on behalf of the Provider) may charge a late‑cancel/no‑show fee up to the full session fee (plus applicable taxes), unless prohibited by law. Emergency exceptions may be considered at our discretion upon written request to support@wecarefast.ca with the subject "Emergency Cancellation".
Provider Delay/Absence. If a Provider is more than 15 minutes late and you choose to terminate the session, you may request a full refund of the scheduled session fee.
Refunds. Except as expressly stated above or required by law, fees are non‑refundable once the scheduled start time has passed.
We may change pricing and fees at any time before your next booking. You are responsible for charges by your telecom/internet providers.

7. Acceptable Use

You agree not to misuse the Platform, including by: violating law; infringing others' rights; impersonation; attempting to access others' accounts; distributing malware; interfering with Platform operations; scraping or automated collection; recording sessions without consent; spamming; harassing; publishing harmful/illegal content; reverse engineering; or building competing services. We may monitor, remove, or restrict content and access where we reasonably believe a breach has occurred.

8. Intellectual Property & Licence

We and our licensors own all rights in the Platform and Content. Subject to these Terms, we grant you a personal, revocable, non‑exclusive, non‑transferable licence to access and use the Platform for your personal, non‑commercial use.

If you submit reviews, feedback, or suggestions ("Feedback"), you grant us a worldwide, perpetual, irrevocable, royalty‑free licence to use and exploit such Feedback without compensation, provided that we will not attribute your personally identifiable clinical information without consent.

9. Third‑Party Services

The Platform may link to or integrate with third‑party websites, software, payment processors, communications tools (e.g., video platforms) and other services. We do not control and are not responsible for third‑party services. Your use is subject to their terms and privacy policies. WeCareFast is not a party to your agreements with third parties.

10. Disclaimers

Platform "as is". The Platform and Content are provided "as is" and "as available" without warranties of any kind, express, implied, or statutory, including merchantability, fitness for a particular purpose, non‑infringement, availability, accuracy, or error‑free operation. We do not warrant any particular outcome from Provider Services and we do not guarantee that Providers are available, suitable, or will accept you as a client.
No Professional Services by WeCareFast.WeCareFast does not provide medical, psychological, psychotherapeutic, social work, or other regulated professional services, and nothing on the Platform is professional advice.
Some jurisdictions do not allow the exclusion of certain warranties; to that extent only, the above exclusions may not apply.

11. Limitation of Liability

To the maximum extent permitted by law, in no event will WeCareFast or its affiliates, directors, officers, employees, contractors, or suppliers be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, revenues, goodwill, data, or business interruption; or personal injury allegedly arising from or related to your use of (or inability to use) the Platform, Content or Support Services, even if advised of the possibility of such damages.

Aggregate Cap. Our total liability for all claims arising out of or related to these Terms or the Platform will not exceed the greater of (a) the amounts you paid to WeCareFast for Platform/Support Services in the six (6) months preceding the claim, and (b) CAD $100.
Nothing in these Terms limits liability that cannot be limited under applicable law (e.g., certain statutory consumer rights). Any claims against Providers must be brought directly against the Provider.

12. Indemnity

You agree to defend, indemnify and hold harmless WeCareFast and its affiliates, officers, directors, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of or related to: (a) your breach of these Terms or misuse of the Platform; (b) your interactions with Providers or third parties; (c) your violation of law or third‑party rights; or (d) content you submit or actions you take through the Platform.

13. Suspension & Termination

You may stop using the Platform at any time. We may suspend or terminate your access (and/or remove Content) immediately with or without notice if we reasonably believe you breached these Terms, created risk or possible legal exposure for us or others, or if required by law. Termination will not affect any fees already incurred or your obligations that by their nature should survive (e.g., indemnity, limitations of liability, intellectual property, dispute resolution).

14. Notices, Communications & Electronic Delivery

You consent to receive communications electronically (e.g., in‑Platform messages, email, SMS where permitted) and agree that such communications satisfy any legal requirement that they be in writing. You are responsible for keeping your contact information current. Standard carrier/data rates may apply.

15. Complaints & Regulatory Matters

Concerns about clinical care should be addressed to your Provider. You may also contact the applicable provincial/territorial regulatory college where services were received. Platform or billing concerns may be sent to support@wecarefast.ca.

16. Governing Law; Venue; Arbitration (BC)

These Terms and any dispute or claim arising out of or relating to them or the Platform are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflicts‑of‑law principles. Subject to the arbitration provision below, the courts of British Columbia (Vancouver Registry) have exclusive jurisdiction.

Optional Arbitration; Small Claims Exception.Except for (i) claims for injunctive or equitable relief, or (ii) claims within the jurisdiction of BC Small Claims Court, either party may elect to resolve any other dispute by confidential, binding arbitration under the Arbitration Act (BC) and the rules of the British Columbia International Commercial Arbitration Centre (BCICAC) by a single arbitrator in Vancouver, BC, in English. Each party bears its own costs and shares the arbitrator's fees equally unless the arbitrator decides otherwise. Class proceedings are waived to the extent permitted by law. If a court finds the class‑action waiver unenforceable, the arbitration provision is severed and the dispute must be heard in court.
You may opt out of arbitration by sending written notice to legal@wecarefast.ca within 30 days of first accepting these Terms. Opting out will not affect other provisions of these Terms.

17. Changes to the Platform and to these Terms

We may update the Platform from time to time. We may modify these Terms by posting the revised version with a new "Last updated" date. Material changes will be notified via the Platform or by email. Your continued use after changes become effective constitutes acceptance. If you do not agree, you must stop using the Platform.

18. Miscellaneous

These Terms are the entire agreement between you and us about the Platform. If any provision is found unenforceable, it will be modified to the minimum extent necessary or severed, and the rest remains in effect. We may assign these Terms; you may not assign without our prior written consent. No waiver is effective unless in writing. Headings are for convenience only. "Including" means "including without limitation." No agency, partnership, or employment relationship is created by your use of the Platform.

Disclaimer (Supplemental)

Scope of Platform. WeCareFast is a technology platform facilitating access to independent Providers. We do not control or supervise Providers' clinical judgment and are not responsible for their acts, omissions, or advice.
Limitations of Telemedicine. Telemedicine may not be suitable in all cases. Providers may recommend in‑person assessment or emergency care.
Eligibility/Discharge. Providers may decline or discontinue care if virtual care is clinically inappropriate, unsafe, or outside their scope, subject to professional obligations.
No Provider‑Patient Relationship with WeCareFast. No clinical relationship exists between you and WeCareFast. Your relationship is solely with your Provider.
Your Responsibilities. You must provide accurate and complete information. Failure to do so may result in sub‑optimal care or termination of access.
Third‑Party Links. Linked third‑party sites or tools are provided for convenience. We are not responsible for their content or performance.
Modifications. We may modify or discontinue all or part of the Platform. We are not liable for resulting unavailability.
Limitation of Liability. To the maximum extent permitted by law, WeCareFast is not liable for indirect or consequential losses or for matters outside its reasonable control. See Sections 10–11.
Language. It is the express wish of the parties that these Terms and all related documents be drawn up in English.
Acknowledgement. By clicking "I agree," creating an Account, or otherwise using the Platform, you confirm that you have read and understood these Terms and agree to be bound by them.
